in that case, he wasn't even driving... so I think it's possible for it to be circumstantial.
Another friend got smashed and permanently disfigured by a drunk who ran a light.

I was in a car with friends. The driver, who I didn't know, was stoned on acid. We went up an overpass where traffic was leaving a busy highway the WRONG way and almost had a head-on with a COP! He let the kid off and got one of us to drive him home.
