Did the girl have fake identification and would a reasonable person feel that she was of age?

If not, then there is no room whatsoever to sue.

As an employer, especially in an adult industry, it is the responsibility of the employer to verify the prospective employee meets all legal requirements to accept employment.

Sounds like there's some missing information. The story goes from 'she walked in looking like an adult' presumably to apply for a job to 'she was kidnapped and sexually assaulted', which seems unrelated to the first part. What the heck was going on here?

Oh..and I worked serving booze at a restaurant when I was 20. I was not legal to do so. I was hired a month before my 20th birthday. I showed my legal identification and somehow they did bad math and thought I was going to be turning 21. Who was at fault there? Me, for not correcting them? Or them, for looking at a valid ID and failing to calculate my age correctly? I always assumed that I was at fault, because I knew and didn't correct them, even though I did not intentionally mislead them.

Where do you live? Just curious, all the states I've lived in you are legal to serve at 18, just not legal to drink until 21. Except in WI... you can drink at 18 there so long as you're with your parent or guardian.

This was in Colorado. They have odd liquor laws. You can serve beer at 18, but hard alcohol and wine, you have to be 21 to serve. Convenience stores could only sell 3.2% beer, instead of the regular stuff, and no hard liquor at all.

Uh, I don't think that's what happened. There isn't enough information, but the impression I got was that she was kidnapped, assaulted, and brought into a strip club by the kidnapper and forced to apply for work. Which she got. Though it's unclear whether she ever actually worked there or not.

Technically, when with a parent, there is no minimum drinking age in Wisconsin. The discretion is left up to the establishment when serving minors with parents/guardians present.

Can children be in a bar with their parents?

Yes. Persons under age 21 may be on licensed premises, and can be sold and allowed to drink alcohol beverages, if they are with their parents, guardians, or spouses, as long as those persons are of legal drinking age; but this is at the discretion of the licensee.

When I got my bartending license in WI 3 years ago the only correct answer on the test was that they had to be over 18. In the past it was any age and it may have been reverted back now, but that's what I was taught.
