I utterly despise Mencia and his theivery, but this one is a bit of a stretch. He didn't use the same lines with a brief rewording like he usually does, he was just covering the same subject. If you look hard enough, you'll find plenty of comics covering this topic. It doesn't mean he stole the jokes.

Not every joke about rape is stolen from George Carlin. (Carlins joke: People say you can't laugh at rape. Sure you can. Picture Donald Duck raping Porky Pig.) If the joke was "Mighty Mouse raping Speedy Gonzalez", you might be able to call that a stolen punchline. But not this.
