I don't think that would fly, but, another alternative would be to section off the apartment/condo complex to have a smoking/non-smoking section.

I know that a few apartments ago we moved into an apartment that was smoked in by the previous renters. We knew it only because even though it was completely repainted whenever we took a shower the steam would release the "baked in" smoke. Over time it went away (or we just got used to it)

I am a non smoker. I was happy to see restaurants(in CA) become non smoking establishments...however, I don't think even in apartment/condos you should be able to tell a person they can not smoke. It is their home and their choice. I might not like it if they are outside and the stuff wafts up to me, but I can go inside MY home and close the window.

i lived in a triplex apartment in which the woman who lived upstairs smoked in. it was DISGUSTING. i had to complain SO many times because i would be taking a nap and i would wake up having something akin to an asthma attack. when the heat was turned on in the winter, all of the smoke would blow straight into our apartment. i can't even tell you how much i applaud this act. if you are a smoker, you know the personal risks involved, and you should definitely keep it to yourself and avoid putting others at risk. it's easy to step outside to have a smoke. there is absolutely no need to light up in an apartment where the circulation is shared.

p.s. i'm a smoker.

It is an erosion of civil rights, they ban this in your home they can ban anything eventually. It is not good.

Your landlord should have fixed the duct system since the air should not have wafted back into your apartment.

Definitely a much better solution than just banning it all together. This is what hotels do, and it seems to work just fine.
