The ban is illegal according to international law per treaties signed by the US specifically because it allows off-track betting but not gambling online.

Unfortunately the $21 million fine levied was a paltry amount relatively speaking

I'm sorry, but I'm watching my best friend's husband do nothing but Texas Holdem online, and can't believe it when he tells her he's ahead - even though it's been illegal in Washington State for about a year.

It's hard to watch.
