XBox Live had some issues over the holidays with the massive influx of new users. Some people could not access the service and so they are now sueing Microsoft for damages.

Wait...A game server is down and you're damaged? I guess they had nothing else to do if they can't play online. For God's sake...read a friggin' book!!!

Somehow this probably doesn't represent Little Johnny but some adult nerd who has way too much time on their hands (and maybe too much money since they hired a lawyer). Yes, Microsoft should have anticipated the influx of new users but I don't think suing for $5mil would solve any problems except giving some whiny people more money which will eventually be spent on Xbox live access anyway.
