A little over the top in charging him. What will be his sentence?

First of all, his buddy needs his ass kicked.

Second of all:

In sentencing Judge Mushtaq Khokar told him: “You have pleaded guilty to distributing obscene material - and of course it is obscene.

“It also related to your former partner of 13 years and it was a very very serious offence. You need assistance from the probation service. You have problems.”

He did not "distribute" obscene material. He gave a copy to someone he thought was a friend. He gave it as a lark. It isn't like he printed up a bunch of copies and selling them. Technically it was distribution, but that is the letter of the law, not the spirit. What he did is not what the law is designed to stop.

Heck he didn't even post it to the net.

He doesn't have a "problem". The judge made it sound like he was some sort of pervert. No he was just a jilted lover striking back.

he is not a danger to himself, others, society, or even animals.

It shouldn't be a criminal matter. Possibly a civil one, that would be for the courts to decide. A criminal charge is a travesty.

A.-- Your right, because I'm sure that girl has a horrible life for engaging in an inter-species sexual act. I mean that is rumored as how AIDS was contracted, and that was serious karma.
