Junk mail rarely brings you something you want, but for one homeowner it has led to a lawsuit landing on his doormat. Paul O'Brien is being sued by a woman who says she trapped her hand in his letterbox while posting mail. Just like a burglar suing for damages when injured on your premises - she was trespassing! How can she prove that it was that letterbox (or even any letterbox) that she injured herself on?

In the US it is illegal for anyone to put anything in your mailbox if they are not a US Postal Carrier. It is a Federal offense (felony mail fraud? not sure) and carries a severe penalty.

Is it not similar in the UK?

Unfortunately not, we routinely get junk mail/leaflets/take away menus thrust through our letterboxes.

Although being a student I must say I don't mind the latter.

Pop round her house and slam your finger in her letterbox when delivering a reply. Then hand deliver a copy to her solicitor and slam another finger in their letterbox and, hey presto, you're 2-1 up!

Oh it is, you just have to prosecute them.

Here is a link to a pdf document (it may not work) it is a copy of a letter sent by a Postmaster to someone who distributed flyers. It gives the code and penalty. The penalty is $300 per offense, plus postage. That means $300 and postage per flyer (not per day or instance of occurance). Distribute 100 flyers and that's $30,000, plus $.41 postage each. Distribute 500 flyers and that's $150,000 plus postage each.

No one really bothers because we like our Chinese food. But it is most certainly illegal.

I'm not sure how this would even stand up in court. How could she ever prove it was THAT house that damaged her finger, unless there was blood and finger-bits on the mail flap, which I'm assuming there wasn't.
The sad part is, she'll probably win, anyway.

So far as I know there's no such law in the UK. And even if there was the postal service is undergoing deregulation, so if it did exist, it will be removed as part of that.

I had a little bit of a hunt around, but couldn't find any mention of legislation, and given how widespread the practice is I think it would be hard to bring about an action, precedents and all that.

Regarding this situation, it is crap like this that makes my home owner's ins so damn high. I know this isn't the US but this is exactly the kind of crap that happens here. It infuriates me. I would love to know when everyone stopped taking responsibility for their own actions and/or stupidity.

If I were a judge, I would laugh this crap out of the court room and fine her for wasting my time.
