Ritt Goldstein testified in front of legislators with international experts in Connecticut regarding Civilian Oversight of Police. Have you people even read the article? It said: "The Bush administration has never argued publicly that the Fourth Amendment does not apply to military operations within the nation's borders."
The memo was a legal opinion "prepared in response to a request from the White House for OLC's views concerning the legality of potential responses to terrorist activity."
It was one man's opinion, regarding what is permissible under extraordinary circumstances, ie martial law.
