Well, good ol' Al is playing with not for profit organizations.
The Feds and IRS are usually a bit touchy about how "charitable" funds are dealt with.
Al, others like him and the various religious organizations, particulary the TV Evangelists, have avoided any intense financial investigation for what are most likely political considerations.
Hopefully, one of these times, the public uproar will overide those sensitivities and empower the IRS to do it's job concerning all not for profits.
