Lt. Burke Jensen has been ordered to Kuwait, leaving behind a pregnant wife, a young son and a 2.5-acre lot with not a spot of landscaping. But he's been told to get lawn and an irrigation system -- or else! "I really don't give a [expletive] where he is or what his problem is," says the subdivision developer.

It can't be said enough. Never ever under any circumstances purchase property that has restrictive covenants.

If the HOA is strictly designed to collect dues and maintain the common areas and set very limited covenants (with restrictions on what sort of covenants can be enacted in the future) then okay. Otherwise, purchase elsewhere.

Except there are laws like the one mentioned in the article...the federal Servicemembers Civil Relief Act prevents any civil legal action from being taken against someone on active military duty overseas.

And to quote the only member of the HOA...that right...ONE MEMBER

"This is a contract. I don't like the way his property looks. This clown gets to do what he wants, and I'm as mad as hell"

This ONE guy is trying to use powers that are beyond the scope of an HOA due to personal reasons.

This ONE guy is trying to use powers that are beyond the scope of an HOA due to personal reasons.

I nominate Chick Edwards as Prick of the Year.
The only chance he has is the law that prevents civil action while he is deployed. Once he returns he is open to a lawsuit or even forfeiture of his property.

From a legal point, it doesn't matter how many members belong to the HOA. In the beginning there will be only one of a very few members. Also most HOA's are set up where the developer's shares have more voting power per share than the residents. So even if there are multiple members of the HOA, often times in the early stages of the neighborhood, the developer can set the restrictions/covenants as he deems fit.

Sadly and why I said it is a bad idea 99% to purchase property with a HOA is that this demand is not beyond the scope of the HOA. The covenants demand that those items be in place. Such things are exactly what so many HOA do. It isn't beyond their scope, it is their scope.

He is most definitely a prick, perhaps even The Prick, but he is far from a rarity. There are a lot of pricks running a lot of HOAs. Best to stay away from them when possible and to have their powers greatly restricted when not possible to avoid them.

Yea, actually you are very likely correct 2many. I guess what I was trying to say is that the guy is a total rimjob. I'll never ever buy a house with an HOA. Last thing I need is a $100 fine for leaving my garbage cans out because my car broke down or some other dumb ass sh*t.

I hate to admit it, but I also belong to a %#$&'n H.O.A.
A few yrs back I received a 75$ fine for leaving my Cmas lights up 6 days past their deadline.

Reluctantly I paid it and now proudly display them YEAR ROUND on the INSIDE of my windows and they can't do diddly squat.

HOA people are crazy control freaks that have no life other than to nitpick everyone else's lives. I would never buy/rent a property that has a HOA. One of my friends was threatened with a fine because he used black trash bags instead of white ones.
