Paul F. Little was sentenced to 3 years and 10 month in prison for distributing to consensual customers videos of adults engaging in consensual and legal behavior. Even though he lived in California, they forced his trial to be in Tampa which would have harsher local standards. I once read an article about Glenn Greenwald (the author), which described him as one of the most prolific internet writers. They say he writes so much, about so little (and with such a strong bias), that he's often a little difficult to take seriously... this is a pretty good example of that.

IMO, this is a pretty silly argument. Inflicting pain upon someone for the purpose of sexual gratification is not the same purpose as obtaining vital information for the safety of millions of people. That seems pretty "duh," to me.

The rules about S&M are pretty much to prevent snuff films, where people get seriously hurt for other's amusement. "Torture" (mind you that Glenn defines "torture" pretty mildly in a lot of instances... "wearing a bra," that's torture?) of a prisoner is not a source of entertainment, rather an attempt (good, bad, or otherwise) to keep other people safe.

But the Greenwald's argument goes both way. While he argues, "If the Bush admin. can do it... why can't porn people?" the reverse arguement can be made, "If it's okay for porn people, why isn't it okay for the Bush admin.?" But for all Greenwald's writing... I doubt he'll answer that one.

He's not so much trying to justify the pornography as point out a double standard at the Bush/Gonzales DOJ. As Sam Waterston likes to say on Law and Order, "You can't have it both ways."

As for detainee abuse, yes, forcing someone to perform an act that makes them "unclean" according to their religion is abuse and a violation of international law. And it has been done for entertainment--people went to jail for it. But still the White House argued for legalization of torture for detainees, even after condemning the Abu Graib incidents.

It's the same kind of double standard that allows some people on the right to say they're for less government in general, while what they really mean is less government intervention regarding, say, gun control, or the minimum wage, but more government intervention in the bedroom.

At any rate, Greenwald is a magazine columnist who wears his politics on his sleeve, not a journalist, so the whole "bias" claim is a bit misplaced, if you ask me.
