She should've killed him. He should consider himself lucky.

Don't know what the law is in New Zealand, but here, if I was on the jury, I would easily acquit if she just said: "I was afraid that if I tried to get away he would wake up and kill me, and I knew if I didn't escape he would eventually kill me."
