In what can only be described as an unreal Kafka-esque situation, city code law enforcement officials in Daytona Beach threaten a shop with fines if their Santa Claus leaves the store.

simple question;

Is the store hiring the Santa to bring in customers to their store? Are they using the obvious draw of a Santa figure to attract attention and hopefully bring in traffic?

Or are they paying him just to bring Christmas cheer to us, everyone.

If they are using him to bring in traffic, then he is definitely advertising and would be in breech of the code.

If he does not display or talk of anything indicating the store, if he doesn't stand near the store, then perhaps you could say he isn't advertising the store. However you know that it is highly unlikely that the company is not using him to bring in traffic to their store. He is advertising the store. Dressed in jeans and a shirt or dressed in a red suit it is all the same.
