Yes there are liability issues. Yes, a waiver could be made useless with a good lawyer. However he could have rescued the cat himself.

Yes there are liability issues. Yes, a waiver could be made useless with a good lawyer. However he could have rescued the cat himself.
Which neighbor are you talking about? The one who called the Animal rescue, the one who did everything he could, and then got his friends to come out and save the cat himself?

Or the neighbor who was yelling for the cat and waking everyone up at 2 a.m.? The neighbor who was trying to 'sneak' up there at night? The neighbor who tried to get the cat to come down, with a water hose, in the dead of winter?

Frankly, I'm with the cop on this one. It seems like he was being reasonable and that safety for humans climbing up a two-story tree to rescue a cat WAS a concern. He did cooperate with everyone who was taking safety procautions and eventually he and his buddies went up there at risk to themselves to help the animal.
