If you're naked outside (in a public space) you don't have this protection. What you do in public is publicly available, and so you can be photographed or filmed without getting rights to it.

But this case pertains to a private place.

The "court had found in a previous case that a reasonable expectation of privacy existed when a nude person reasonably believed he or she was "secluded from the presence of others."

So outside doesn't count. This case had her in her own home being unknowingly filmed. But if she had done the deed outside, no protection.

So if you flash your boobs at Mardi Gras in New Orleans, someone can film you and sell it and you're screwed.
