Instead of spending money on attorneys to try to smear the reputation of this young lady why don't they use that money to redesign the car or at least look into what the failure could have been?

Wow. How low can you get? I expect big corporations to be slimy, but this is beyond disturbing.

I don't believe - or rather I don't want to believe - that that Chrysler would be successful in their subpoena attempt.
It seems like a fishing expedition, searching for some sort of content. That in itself is not allowed.
Furthermore there doesn't seem to be anything in there that could possibly help their case. Without knowing the details of the case it is hard to understand what could be there.
Even if she said she got drunk everyday (which it doesn't I'm just taking it to extremes) that wouldn't be admissible because toxicology reports showed she didn't have alcohol in her blood. It also wouldn't be admissible because it isn't proof that she got drunk everyday.
Even if it said she was suicidal it would be hard to make the claim that she allowed the car to hit her. Perhaps that is what they would try to do? That she could have avoided the other driver but was despondent? Again you couldn't prove that, you can't prove that she could have avoided the accident. It is easier to prove that she couldn't have avoided the accident due to timing, traffic, etc.
Perhaps they'll show some sort of major stress she was going through and she might have been preoccupied. They might try and claim that she could have avoided the accident except for her daydreaming?
Again, impossible to prove and in any case unless they have reason to believe it is there it is still a fishing expedition.
Now personally I have to say - again without knowing the case - they should never have sued Chrysler. She got hit by a car which went over the center line. What sort of design flaw could there have been? A problem with steering? A tendency to veer to the right or left if the driver doesn't hold onto the steering wheel? Problem with brakes?
Did a quick search and I didn't see hundreds of pages from other people who were accidents caused by this alleged "design flaw"
The driver went over the center line. He is 100% responsible.
Chrysler is apparently trying some stupid bs, but I would like to know what this alleged design flaw is that the family felt they needed to sue the car maker for in addition to the driver

This is basically what Chrysler Thinks:
OMFG SHE SMOKED A LIL WEED BEFORE. THE ACCIDENT WAS CAUSE BECAUSE SHE MUST BE A TOTAL BURNOUT AND THATS THE REASON WHY SHE GOT IN THE ACCIDENT.
