Sperm bank sued under product liability law
Sperm bank sued under product liability law
13-year old Brittany Donovan was born with a birth defect. Her mother had utilized the services of a sperm bank. Because test prove the birth defect was inherited from the father, she is suing the bank under product liability laws much as you would if you purchased a defective television or brakes. picked by 2manyusernames 3 years ago

Good post. There has to be some kind of grey area in the laws governing sperm donation.

I'm hoping that the legal briefs on both sides will do more research on this than I did before it goes to court, but in this there's no mention of screening sperm.

The obligation to my eye would be for the claimant to prove there was reasonable expectation, either contracted for or implied that there would be screening for this disorder.

I'd also expect that the sperm bank would have a protection built into their contract.

Something like Errors and Emissions excepted.

I'm guessing that grey area has some stains on it.
