my live account is set up through my dads credit card and i know that i can order everything from the marketplace and it won't prompt me at all

I have to side with Microsoft on this one. The son is the one that misrepresented his age in a contract when he signed up. He probably didn't uncheck the box that said to automatically renew every year. The son is the one owing his dad the overdraft fee, not Microsoft.

I tell you what Pop, Microsoft will reimburse you for all your fees, including overdraft fees (but nothing else, only actual damages) *IF* you have your son arrested and placed into juvenile detention for identity theft.

Obviously that won't happen. So go away little man. Be a father, teach your son better and this won't be a problem. It is solely, 100% the dad and son's fault. Microsoft did nothing that anyone els wouldn't have done.

I agree. I hope the courts rule in favor of Microsoft and require 'dad' to pay all of Microsoft's court costs.

If we saw more of this, maybe people would be a little less eager to go after huge companies like this in the hopes to get rich quick.

Wake up dad. Ground your son for life. Maybe this will keep him from getting thrown in prison later on in life when he commits a larger scale fraud.

Also since he isn't about to send his kid to juvie, I would think he'd have to prove that it was done without his consent. We only have his word on that. I don't doubt that the kid did do it without dad's permission, but there is no actual proof of that. The fact that the bill caused him to overdraft his checking account isn't proof.

Isn't it his responsibility to keep his credit card away from his son? But on another note xbox live did start harassing me to purchase another year of live in august when my subscription was still good for another 10 months or so, slightly shiesty not that I won't eventually purchase another year of xbox live. I love the service well worth every cent.
