These sort of things happen from time to time.

No damage done. You can not prove that a reasonable and competent doctor would 100% have ascertained he was alive, mainly because as I said these things happen.

Wait. Dude gets hit by a car hard enough that he's assumed dead on the scene... can't talk and can barely move...

and he lays in a freezer in a body bag for three hours and you say NO DAMAGE DONE?

I sincerely hope you're joking... waking up in a freezer in a body bag would probably crack me.

I sincerely hope you're joking... waking up in a freezer in a body bag would probably crack me.

Of course there is no damage. It isn't like the guy was fully awake, coherent, and fully aware. He was out of it. He had no idea he was in a bag. With all that was going on health wise, being mistaken for the dead is the least of his problems.

No, there was no damage. There was no real malpractice here. Such things happen more often than you realize. No one is hurt or disturbed. The family is just looking to cash in.

IF they guy was fully alert the whole 3 hours, then there might be a reason to sue, but if he was, he wouldn't have been thought dead.
