He was charged for Aggravated assault, with deadly force or what not. He served his time, but now she died. This going from Assault to an actual Murder. How much time he will get is up in the air.

I agree. While it's not technically double jeapordy, there should certainly be something that his lawyers can find to get him through this. In no way am I justifying what this man did, and in my opinion he should have been tried for murder whether she died or not (since death was a likely outcome of his actions), but if he's served the sentence for his actions he shouldn't have to serve again for the same action.
