They accepted her as a tenant. They knew she was married. They should have had his info on the initial application. If they had declined it then, that would have been acceptable. If they failed to take his info into account and knew he was going to live there then they should lose the right to look at his application after the fact.

So what if another adult is there? They accepted her as the tenant. They accepted her as the person responsible for the rent.

They shouldn't be able to evict for bad credit since they accepted her. Heck I sell houses all the time using only 1 spouse due to credit issues. Mortgage companies are fine with that but not some rental place?

You can get approved for any loan using only 1 spouse's info. Your credit card company doesn't look at your newly wedded spouse to see if you can retain your card (or any other loan)

Consider this scenario:

She has a 17 1/2 year old son. She applies for the apartment and gets accepted. When the kid turned 18 would they insist that he be on the lease? Would they kick her out if the kid had bad credit?

Perhaps, and it is very flimsy, if he was turned down for prior evictions due to drunken or rowdy behavior, some sort of criminal history, etc, then there would be some justification with denying him the right to live there. Of course there would still be the bigger question:

The question is why wasn't he on the application? Yes, he may not have been able to sign it and perhaps that is the reason, but it still seems odd that they wouldn't have had asked for his and all adults that will be living in the place or that she didn't just add it.

I wonder if they counted his income on the application or did she qualify on hers alone/

If the guy was away on business or in school, would she not have added his name? Would the leasing company have not asked for his info?

Yes they would - or at least you'd think so.

This is very very strange as well as being f'd up. Not to mention a horrible way to treat a military person
