It sounds as though the father has custody, at least. That's a good thing.

Sounds too like the daughter is going to need intense therapy.

I am a good mother. I must always remember this. I am not mother of the year, but when sick crap like this happens it reminds me that I am doing pretty good.

coming to the sentence saying the victim's parents were divorced, it immediately gave me the impression that the mother did it to spite her ex-husband. i've heard of cases like that before; where the ex harms the children to attack the other ex. but in the other cases, it was the ex-husband doing the spiteful thing to get at the ex-wife ... it's even more disturbing to hear that the mother would compromise the sanctity of her daughter's well-being.

i think the mother needs therapy more than her daughter .. or her ex-husband's daughter, i should say. any woman who'd do that to their offspring isn't a mother anymore.

This is the second case I've read where someone is getting arraigned on Child Pornography via Photoshop. Is this really how you can be prosecuted? Yes, it's sick (btw) but I wonder about the legality. From what everyone has said, the child itself is not the person in the photograph... People post manga/hentai pictures all the time (cartoon sex) which can involve children/underaged.. But when a child's face is superimposed over someone elses face it becomes child porn?

I was thinking the same thing as I read that story. As sick as it is it is not a picture of the child naked or engaged in sex. It is a really odd idea that that could be considered child pornography. I would be interested to find out how this turns out.

I don't know for certain. But I do recall hearing the similar cases like this one, i believe the general laws of child abuse, via pornagraphy, cover any image of a child purposely included within a photo depicting pornography. It is including a child in a sexual act.
Seeing a child included, while doing whatever it is people do while looking at porn, could be emotionally damaging. Especially if you know the child.
The main difference with this and manga/hentai/anime, is that those characters are legally not a real person and therefore cannot be damaging to anyone that chooses to see them.

edit: softcore pornography can still be presented in court as pornograpy, even though there is no sex.

Or jealousy. If she was posting pics of herself she seems to be an looking for attention and may see her daughter as a threat to any attention she may get.
