Yes, its a litigious society and yes that seems a little extreme, but really, money is the only way to get things to change. She could have sued for millions and didn't. Do you know how often people are assaulted because they don't conform to someones standards of what a girl or a guy SHOULD look like? Money makes people pay attention. and attention on a subject can create change.No one is saying she has to 'reek' of femininity..but when you go out of your way to look like a man, and do so so successfully, expect to be mistaken for one.

Is he supposed to stand there for the duration, telling everyone 'It's ok, she really is a female.'? She'd be filing a lawsuit about that..

He didn't want to do that because he obviously has a thing against such women.I don't think either of our arguments can be proven either way in a 100 word article, but I guess I just see more people making frivilous lawsuits more often than I see actual "prejudice" over a girl looking like a guy. Rude comments maybe, but not prejudice.

A line like "Ms Farmer said she volunteered to produce identification proving she was female but was rebuffed" could have just been the guy saying.."I don't want to see ID, just get out please". Could have been other women in the restroom and he could have been nice as pie and just didn't want to get further involved. Or...he could have been prejudice against lesbians, knew the gay pride parade was in town and was looking to piss one off.

It's New York so it definetely could have gone either way.

I guess when I see something like this I give the guy being sued the benefit of the doubt..the whole "until proven guilty" thing...but businesses will never really fight for their empolyees, they'd rather just pay and make it go away hence all the lawsuits. :)
