No damage done. You can not prove that a reasonable and competent doctor would 100% have ascertained he was alive, mainly because as I said these things happen.

Of course there is no damage. It isn't like the guy was fully awake, coherent, and fully aware. He was out of it. He had no idea he was in a bag. With all that was going on health wise, being mistaken for the dead is the least of his problems.
No, there was no damage. There was no real malpractice here. Such things happen more often than you realize. No one is hurt or disturbed. The family is just looking to cash in.
