We'll see how it plays out but I had a feeling, if this is true, that the "assault" was more on the looney side of the definition.
My assumption was based on some of the crazy stuff I've been reading about what constitutes "assault" in the UK these days.

The ALL-KNOWING, ALL-POWERFUL WIKI defines assault (in England and Wales) as "a person intentionally or recklessly causing another person to apprehend immediate and unlawful violence." So if the victim thinks she/he/it is going to be the victim of physical violence, the offender is committing assault. Actually committing physical violence is battery.

Good definition.
Battery doesn't actually have to involve physical contact either, it can be as small as spitting on someone.
