Colorado subdivision bans a peace symbol shaped wreath.
Colorado subdivision bans a peace symbol shaped wreath.
A homeowners association in southwestern Colorado has threatened to fine a resident $25 a day until she removes a Christmas wreath with a peace sign that some say is an anti-Iraq war protest or a symbol of Satan. picked by Alton 2 years ago

Ditto that Alto. WTH... I've never never never heard before that the peace sign is associated with Satan. Unless they're thinking it's Elhaz (sp?) upside down... nah, I'm not giving them that much credit.

Why do you have a committee to oversee the rules of the homeowners association? Wouldn't it be to have several points-of-view and opinions so that a "problem" could be addressed from several different view points? So what good does it do to have one a$$#0l3 who can override the whole committee and even go so far as to fire them?

This happens several 1000's of times a day. All the "satan symbol", "anti-war", and the rest is just b.s. padding.

This is yet another example of why homeowners associations can be a horrible thing. They can be good when they stick to maintaining roads and a limited degree of appearance rules.

However many many of them are very dicatorial. Still, the owners of the property were fully aware of this before they bought the property. They would have received a copy of the bylaws as well.

Personally, I wouldn't buy property that was controlled by a HOA.

wow, that Kearns person looks like a power hungry dictator, firing the entire committee. If she wants to hang it there, she has the right to do so. Unless homeowners association rules are considered above the freedom of speech/expression rule.

Maybe that Kearns guy should think about getting a life...

I think some laws were broken when that Kearns guy/woman/thing fired the commitee members. Commitee member can only be fired if the whole of the commitee votes unanimous to fire another member. Even the commitee leader can't do that.

And how the heck does a Homeowners commitee have such power anyway. Do they even have legal grounds for such a thing ?

I would say, lets take this to a judge, and let the HOA pay for their sins.

sadly no laws were broken. Nothing really here for a judge to look at, other than to determine if the HOA is interpeting the bylaws correctly.

I love her line about they can't make me pay. Well you're probably right, they probably can't force you to pay, but they can and will put a lien against your property.

HOAs have such power because the homeowners grant it to them.

I deal alot with HOAs from selling manufactured homes and land. Some are great. Some do nothing much more than charge fees that are used to maintain common areas, including road maintenance. In this aspect, they are golden. As I said, as long as they maintain a small degree of design regulations all is fine. Some however are granted way too much power and can determine any aspect to your home and property. The can allow or disallow types of driveway, siding, attachements, decks, use of external antenna/sattelite dish. etc, etc etc.

As I said above, people should think twice and read the bylaws several times before purchasing property with HOAs.

She says she "doubts they can make her pay" but she sounds like she is willing to pay the $1000.00 just to make a statement.

She's also a past associate president, so maybe she's got a trick up her sleeve. I'm wondering if she wasn't president of this HOA, and maybe this is just some bad blood.

But your right 2manyusernames, HOAs weild a lot of power, and thus the reason I wouldn't buy a home where there is one.

Now if I can just get my neighbor to move his "You Call, We Haul" business to some other location than his front yard. Oh well, the choices we make.

the HOA that I have would go this far...and farther. I woulden't be suprised if I hung an oval shaped wreath they would have a fit.

My HOA sent nasty letters to my neighbour because her kids played outside in the front yard. They also sent fines to everyone on the street because their trash bins were out (and they failed to realize it was trash day)

If there's a good HOA out there, I've never heard of one.
