A Massachusetts family is suing a hotel here, alleging that a 22-month-old boy choked on and ingested the contents of a used condom that was left behind in the room they stayed in during an overnight stay on Jan. 2-3.

« dollyllama : The burden of proof is on them, I'd like to see how they are going to prove this. you're right. they would have to subpoena the records of who was in the hotel previously, then somehow subpoena or otherwise get the occupant to give a dna sample - assuming there was a male guest and not a male visiting.
Perhaps then they would have proof that it didn't get cleaned by the maid.
If this happened it is a horrible thing. However I think their description of it and such things as "permanent damage" is a bit over the top and makes me feel that like so many they are looking to make this into a lottery win.
However I realize that a lawsuit requires a bit of over-the-top exaggeration so I suppose I'll postpone judgment at this time.

I can't wait for future warning signs on the hotel rooms doors.
"This room may or may not contain used condoms. Ingesting and swallowing contents may cause mental anguish, emotional distress, traumatic and permanent psychological injury, and/or emotional torment."

I am shocked that your first reaction is to blame the mother. The complaint clearly stated she was in the bathroom helping her other child. Bathrooms are IN the rooms, are they not? And what parent takes ALL their kids to the bathroom with them?
The fault is clearly with the hotel for not cleaning up properly.

The simple truth is the story could be BS. Nothing more than an attempt to extort money out of the hotel.
Yes, it could be true. The mere fact that the woman claimed it happened doesn't mean that it did.
That was the point that some was making. You need proof, not just a claim.
